An occupier of a place of work to which this section applies shall appoint a person who is competent to act as a safety and health officer at the place of work.
The safety and health officer shall be appointed exclusively for the purpose of ensuring the due observance at the place of work of the provisions of this Act and any regulation made thereunder and the promotion of a safe conduct of work at the place of work.

What is the difference between an SSS and an SHO?
An SSS supervises safety on construction activities and is appointed by the principal contractor under CDM 2024 reg 39. An SHO is appointed by the occupier or employer under s.29 of the OSH Act 1994 and is registered with the Director General of DOSH.
Who must appoint a Site Safety Supervisor?
Under CDM Regulations 2024 [P.U. (A) 147] reg 39(1), the principal contractor of a construction project must appoint a competent person as site safety supervisor to help it meet its duties under these Regulations. Reg 39(2) sets the penalty: a fine of up to RM50,000, imprisonment of up to six months, or both.
When is a Safety and Health Officer needed?
Under s.29 of the OSH Act 1994, employers in the industries specified by the Occupational Safety and Health (Safety and Health Officer) Order 1997 must appoint a registered SHO. DOSH's guidance page states that on construction projects this applies where the total contract price exceeds RM20 million.
Can one person be both SSS and SHO?
DOSH's SSS page states that a person cannot hold SHO and SSS registration at the same time.
