OSH Act 1994 [Act 514], as amended by the OSH (Amendment) Act 2022 [A1648]
The cornerstone of Malaysian workplace safety law. Since 1 June 2024 the Act covers all places of work, including the public service, except domestic service, the armed forces and work on board ships (First Schedule). Key changes: the mandatory OSH Coordinator for five or more employees where no SHO is required (s.29A, fine up to RM50,000 or 6 months), increased penalties of up to RM500,000 or 2 years, or both, for any person breaching general duties (ss.15–18B, s.19), and director liability with a due-diligence defence (s.52).
